1.はじめに

カバー株式会社(所在地:東京都港区三田三丁目5番19号 住友不動産東京三田ガーデンタワー  代表取締役:谷郷 元昭)(以下「当社」といいます。)は、当社の提供するホロアース及びこれに付随するサービス(以下、総称して「本サービス」といいます。)における、本サービスのユーザーの情報及び個人情報を収集、利用等を行う場合の収集、利用等の取り扱いについて、本プライバシーポリシー(以下「本ポリシー」といいます。)を制定いたします。

本ポリシーをお読みいただき、事前にご同意の上、本サービスをご利用いただくようお願いいたします。

なお、ユーザーがアメリカから本サービスをご利用の場合、Privacy Policy for US Residentsが適用されるため、そちらをご確認ください。

2.取得する情報

当社は、本サービスのご利用に関連して、以下の情報を取得いたします。

アカウント情報、メールアドレス、生年月日、ログイン情報、他サービスの事業者(Google、Apple等)より提供される情報、当サービスの閲覧・書込み等の利用情報、他の利用者とのコミュニケーションの内容、Cookie、利用機器情報、インターネットドメイン名、IPアドレス、調査情報、その他本サービスの適切かつ円滑な運営のため必要となる情報

本サービスでは、ユーザーがチャット等の機能により情報を公開できる場合があります。この場合、当社が当該コンテンツや情報へのアクセスをコントロールすることはできません。ご自身の適切な判断をもって当該コンテンツ及び情報の公表を行ってください。

本サービスの中には、Twitter, Googleなどの第三者のアカウントを利用して登録やログインする場合、ユーザーの名前、電子メールアドレス、写真、性別、誕生日、場所、フレンド、フォロー、掲載コンテンツなど、ユーザーが当該アカウントに基づき保持している情報が当社に開示される場合があります。当該第三者には本ポリシーが適用されず、当社は当該第三者による情報開示について責任を負いません。第三者のアカウントを利用して本サービスを利用する前に、当該第三者のプライバシーポリシーをご確認ください。

上記に定めるほか、当社は、個人を特定することができないユーザーの情報又は特定できないように加工したユーザーの情報を、法令の認める範囲で、ユーザーの同意を得ることなく使用することがございます。

※本サービスのご利用に関して、利用履歴を収集、記録、分析するため、Google Analyticsを利用しています。

利用にあたり、ユーザーの訪問履歴を収集しますが、収集されたデータには、特定の個人を識別できる情報は含まれておりません。

また、アドオン設定でGoogle Analyticsを無効にすることにより、当社のGoogle Analytics利用によるお客様の情報の収集を停止することも可能です。詳細は下記サイトをご確認ください。

4.個人情報の第三者提供

当社は、以下に掲げる場合を除き、ユーザーの個人情報を第三者に提供及び開示することはございません。

(1)ユーザー本人の同意がある場合

(2)ユーザーにサービスを提供する目的で、当社からの委託を受けて業務を行う会社(当社と守秘義務契約を締結します)へ提供する場合(運送業者へのお届け先情報などの開示等を指します。これらの会社が、当該業務に必要な範囲を超えて情報を利用することはできません。)

(3)裁判所、弁護士会及び警察等の公的機関から法律に基づく正式な照会を受けた場合

(4)人の生命、身体および財産等に対する差し迫った危険があり、緊急の必要性がある場合

5.個人情報の保存期間

当社は、ユーザーの個人情報について、利用目的達成後(本サービスの終了を含みますがこれに限られません)に遅滞なくこれを適正な方法で消去、破棄、又は不可逆的に匿名化します。

6.個人情報に関するユーザーの権利

ユーザーは、当社に提供したユーザー本人の個人情報及び第三者への提供記録について、開示、訂正、利用の停止、削除を求めることができます。ただし、一定の場合、当社はユーザーの要求の全部または一部を拒否することができるものとします。

7.個人情報の安全の確保

当社は、ユーザーの個人情報を慎重に取り扱い、物理的、技術的および手続的な予防策の導入を含め、ユーザーの個人情報を不正アクセス、利用または開示から保護するための合理的な手段を講じています。当社が講じる安全管理措置の内容についてさらに詳しくお知りになりたい場合は、末尾記載のお問い合わせ先までご連絡ください。

8.個人情報の開示等の請求

Holoearth Privacy Policy

1. Introduction

COVER Corporation (with an address of Sumitomo Fudosan Tokyo Mita Garden Tower, 3-5-19 Mita, Minato-Ku, Tokyo, 108-0073, Japan; represented by Motoaki Tanigo, its Representative Director) (“Company”) hereby establishes this Holoearth Privacy Policy (“Policy”), which shall set forth how the Company collects the information of users of Holoearth, a product provided by the Company and any related services (collectively, “Services”), and the personal information of such users, as well as when and how the Company collects and handles such information for certain purposes of use.

Please read this Policy carefully. You will need to agree to this Policy before using the Services.

2. Information that is obtained

The Company shall obtain the following information in connection with your use of the Services.

Account information, e-mail addresses, birthdate, login information, information provided by other service vendors (e.g. Google and Apple), information related to purchasing, viewing and using the Services, any content that is communicated with other users (including chat messages), cookies, information related to devices that are used, internet domain names, IP addresses, information to be gathered to improve the Services, information gathered when there are notices in the game and when there are inquiries, and any other information that is necessary to appropriately and smoothly operate the Services.

Notes

  1. Information that the user publicizes on his/her own

In the Services, users may publicize information by using functions such as chats. In such circumstances, the Company does not have the ability to control access to such content and information. If you decide to publicize content and information, you agree that you are doing so based on your own appropriate judgment.

  1. Information obtained from third-party accounts

If you register or login to the Services using a third-party account, such as Twitter or Google, it is possible that information that is held in that account (including usernames, email addresses, pictures, gender, birthdays, locations, friends, follows, posted content) may be disclosed to the Company. This Policy does not apply to such third parties and the Company shall not bear any responsibility in a any manner whatsoever regarding the disclosure of information to the Company by third parties. Before using third-party accounts to use the Services, please read the privacy policies of such third parties.

3. Purposes of Use of Personal Data

  • To provide the Services
  • To register accounts
  • To communicate with other users
  • To provide campaigns via social media that relate to the Services
  • To support users
  • To find improper uses of the Services
  • To introduce events, campaigns, surveys, new types of services, etc.
  • To engage in marketing activities
  • To improve the Services and other services that the Company operates

Other than for the purposes set forth above, the Company may obtain anonymized information of users or information that is processed in a way so that users are not able to be identified. In such cases, the Company may use such information without the consent of a user for purposes that are permitted by laws and regulations.

Note

The Company uses Google Analytics to collect, record and analyze the records of use of users in connection with their use of the Services.

With respect to users’ use of the Services, the Company collects information related to the history of when the user visited the Services. However, the data that is gathered does not include information that can identify the individual.

Also, it is possible for you to stop the gathering of your information in this way through Google Analytics by invalidating this function in your settings with Google. For details, please take a look at the following website.

4. Provision of Personal Information to Third Parties

The Company will not provide or disclose the personal information of users to third parties except for the following circumstances.

  1. After obtaining the consent of the user, himself or herself
  2. When providing information to a contractor of the Company (that is required to enter into a non-disclosure agreement with the Company) for the purpose of providing the Services to users (e.g. providing delivery vendors with users’ addresses). (These vendors may not use information beyond the necessary scope of the services they provide to the Company.)
  3. When the Company receives a formal inquiry based on law by a public institution, such as a court, a bar association or the police
  4. When there is imminent danger to someone’s life, body or assets and there is a need for urgency

5. Period of Retaining Personal Information

After the purpose of use of the personal information of users has been fulfilled (including but not limited to the termination of the Services), the Company shall promptly delete, destroy or irreversibly anonymize such information by an appropriate method.

6. Rights of Users related to Personal Information

Users have the right to request to have their own personal information that they provided to the Company, or that was provided or recorded by a third party, revealed, modified, no longer used or deleted. However, under certain circumstances, the Company shall be able to deny all or part of a user’s requests.

In order to make such requests, please contact us by the method indicated at the bottom of this Policy.

7. Securing the Safety of Personal Information

The Company shall handle the personal information of users carefully and shall implement reasonable security measures to protect such information from unauthorized access, use or disclosure, including the use of physical, technical and other procedural preventative measures. If users would like to know the details of the security management measures that the Company takes, please contact us by the method indicated at the bottom of this Policy.

8. Requesting Matters related to Personal Information

If the user desires to know what the purpose of use of his or her personal information is or to have such information revealed, modified, no longer used, deleted, etc., the Company shall promptly respond to the user’s request based on laws and regulations.

9. This Policy is Governed by Japanese Law

This policy is governed by Japanese law. It is targeted to users that reside in Japan but also applies to users overseas to the extent permitted by applicable laws. Please also note that we have a separate privacy policy for users who reside in the United States.

Holoearth Privacy Policy for US Residents

COVER Corporation (“Company”; or “we”, “us”, “our”) hereby establishes this Privacy Policy for US Residents (“Policy”) which shall set forth how the Company collects the information of US users of Holoearth (“user”; or “you”, “your”), a product provided by the Company and any related services (collectively, “Services”), and the personal information of such users, as well as when and how the Company collects and handles such information for certain purposes of use.

Please note that there is a separate Holoearth Privacy Policy that is governed by Japanese law for all other non-US users.

1. Information We Collect

We collect information that identifies, describes or could reasonably be linked to a particular user or his/her device (“Personal Information”). In particular, we will collect the following categories of Personal Information from our users:

We do not collect any other Personal Information other than what is listed above.

We obtain your Personal Information listed above when you (i) register your personal account for our Service, (ii) access or use the Service, and (iii) communicate with us for inquiries about the Service.

  1. Information that the user publicizes on his/her own

With respect to users’ use of the Services, the Company collects information related to the history of when the user visited the Services. However, the data that is gathered does not include information that can identify the individual.

3. Disclosure of Personal Information

We may disclose your Personal Information to a third party for business purposes or commercial purposes. When we disclose Personal Information to service providers for business purposes or commercial purposes, we enter into a contract that describes such purposes and requires the service providers to keep such Personal Information confidential and to not use the same for any purpose except for performing the contract.

As of the date this Policy was established, during the preceding twelve (12) months, we have not shared or disclosed the following categories of Personal Information from the above list to any third parties for business purposes or commercial purposes.

4. Sales of Personal Information

We have not sold any Personal Information in the preceding twelve (12) months.

5. Children under the Age of 13

As used in this Section, the term “child” or “children” means those under the age of 13, and the term “parent” includes legal guardians.

Our services are intended for general audiences and are not targeted at children. We do not knowingly collect, use or share any Personal Information about children. If you are a parent and believe that your child has provided us with Personal Information, please contact us by using the form we set forth below and request that your child’s information be deleted from our system. If we learn that we have inadvertently collected Personal Information from children, we will deactivate the relevant account or accounts and take reasonable measures to promptly delete such Personal Information from our records.

6. Your Rights and Choices under Applicable Law

Depending on your jurisdiction, in accordance with applicable laws, you may have several rights in relation to our processing of your Personal Information, which may include requesting access to, correcting or deleting your Personal Information.

If you are a California resident, the California Consumer Privacy Act (“CCPA”) provides consumers who are residents of California with specific rights regarding Personal Information. The following parts A through F of this Section describe your CCPA rights and explain how to exercise such rights. Please refer to section (e)(3) below to read about what a “verifiable consumer request” is.

  1. Right to Access Specific Information

You have the right to request that we disclose certain information to you about our collection, sharing, disclosure, or use of your Personal Information over the past twelve (12) months from the time of your request. Upon receiving and confirming your verifiable consumer request, we will disclose the following information to you:

  • the categories of Personal Information we have collected about you;
  • the categories of the sources of the Personal Information we have collected about you;
  • our business or commercial purposes for collecting or selling such Personal Information;
  • the categories of Personal Information disclosed for business purposes or commercial purposes; and
  • the specific pieces of Personal Information we have collected about you.

Please note that we have not sold any Personal Information in the preceding twelve (12) months, and we have no plans to do so in the future.

  1. Right to Request Deletion

You have the right to request that we delete any of your Personal Information that we have collected from you and retained, subject to certain exceptions. Upon receiving and confirming your verifiable consumer request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

  • complete the transaction for which we collected Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you;
  • detect security incidents, protect against malicious, deceptive, fraudulent or illegal activity, or prosecute those responsible for such activities;
  • debug products to identify and repair errors that impair existing intended functionality;
  • exercise free speech, ensure the rights of other users to exercise their free speech rights, or exercise other rights provided for by law;
  • comply with the California Electronic Communications Privacy Act;
  • enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
  • comply with legal obligations; or
  • engage in other internal and lawful uses that are compatible with the context in which you provided the information.

  1. Opt-Out Rights

Opt-out rights do not apply as we have not sold and will not sell any Personal Information collected from consumers.

  1. Non-Discrimination

We will not discriminate against California residents for exercising any of their rights under the CCPA. Moreover, unless permitted by the CCPA, we will not:

  • deny you access to the Services or any in-game goods or services;
  • charge you different prices or rates for the Services or any in-game goods or services, including through granting discounts or other benefits, or imposing penalties;
  • provide you a different level or quality of the Services or in-game goods or services; or
  • suggest that you may receive a different price or rate for the Services or in-game goods or services or a different level or quality of goods or services.

  1. Exercising Rights under the CCPA
  1. To exercise your rights under the CCPA to access or delete your Personal Information as described above, please submit a verifiable consumer request to us as detailed in subsection (3) below by contacting us in the manner set forth in Section 8 (Contact Us).

  1. Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.

  1. A “verifiable consumer request” must:
  • provide sufficient information that allows us to reasonably verify that you are the person whose Personal Information we have collected or that you are an authorized representative; and
  • describe your request in sufficient detail to allow us to properly understand, evaluate and respond thereto.
  1. Response Timing to Verifiable Consumer Requests
  • We will confirm receipt of your request within ten (10) business days.
  • We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.
  • If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.
  • Any disclosures we provide will only cover the 12-month period preceding our receipt of your request.
  • We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

7.Amendments to this Policy

We will review and improve the contents of the above items regarding the handling of your Personal Information as appropriate. When changes are made to this Policy, an update notice will be posted on the website and will be effective as of the date posted.
